MEAL DELIVERY TERMS & CONDITIONS

This Weekly Service Agreement (“Agreement”) governs meal preparation and delivery services provided by Melogold Kitchen,

operating in Oakland, California (“Melogold Kitchen,” “we,” “us”).

By enrolling in weekly service, you (“Client”) agree to the following terms.


1a. MEMBERSHIP: Weekly Service & Automatic Renewal

Melogold Kitchen provides a weekly recurring meal delivery service. Your service automatically renews each week unless canceled in accordance with this Agreement.

Menus are released on Wednesdays. Clients must submit all selections and customization requests by Saturday at 2:00 PM for the following week’s delivery.

By enrolling in a membership meal plan, Client authorizes Melogold Kitchen to charge the selected payment method on a recurring weekly basis until the membership is paused or canceled in accordance with this Agreement. 

 

1b. DROP-IN: Weekly Service 

Drop-in clients have no weekly commitment, but must agree to return all of their re-usable tupperware the following tuesday (Melogold will pick-up on their delivery route)

Menus are released on Wednesdays. Clients must submit all selections and customization requests by Saturday at 2:00 PM  for the following week’s delivery.

 

2. Menus & Customization

Each week, Melogold Kitchen offers a seasonal menu with the following customization options: Gluten Free, Dairy Free, Low Carb, and Vegetarian.

We will make reasonable efforts to accommodate customization requests; however, not all requests can be guaranteed. By participating in the service, Client acknowledges that menus are collaborative but final preparation decisions rest with Melogold..


3. Food Safety, Storage & Reheating

Meals are prepared and stored in accordance with applicable FDA and California food safety standards.

Recommended consumption timelines:

  • Meat: within 4 days of delivery
  • Fish: within 3 days of delivery
  • Other items: within 5 days of delivery

Client assumes responsibility for proper reheating, handling, and food safety once the meal is delivered.

To the fullest extent permitted by law, Melogold Kitchen is not responsible for illness or injury resulting from improper storage, reheating, handling, or failure to follow provided instructions.


4. Allergies & Dietary Disclosures

Melogold Kitchen can accommodate mild allergies and follows standard sanitation practices; however, we are not a certified allergen-free facility, including nut-free or gluten-free.

Cross-contamination may occur. Our services are not intended to meet medical or severe allergy needs. Client assumes all risks related to food sensitivities or allergic reactions.


5. Pausing & Cancellation (MEMBERSHIP only)

Clients must submit pauses, cancellations or meal plan changes at least 7 days prior to the scheduled delivery ie. the Tuesday prior.

  • Cancellations or pauses within 6 days or less of delivery will be charged in full
  • Meal plan increases may be made at any time
  • Meal plan decreases require 7 days’ notice

6. Payment Policy

6A. SUBSCRIPTION PAYMENTS (MEMBERSHIP)

Membership meal plans are billed on a recurring weekly basis using the payment method selected at checkout. By enrolling in a membership, Client authorizes Melogold Kitchen to charge the selected payment method automatically each week until the membership is paused or canceled in accordance with this Agreement.

Subscription charges are processed prior to the scheduled delivery week. Failure to submit payment or maintain a valid payment method may result in paused or suspended service until payment is successfully completed.

6B. SUBSCRIPTION PAYMENTS (MEMBERSHIP).

Drop-in meal orders are billed as one-time payments and must be paid in full at the time of purchase. Orders will not be prepared or delivered until payment is successfully processed.

Failure to submit payment may result in cancellation of the order.

6c. Payment Processing

Melogold Kitchen uses trusted third-party payment processors, including Stripe, Square, and PayPal, to process payments securely. When you choose a payment method, your payment information is collected and processed directly by the selected provider in accordance with its own privacy policy. Melogold Kitchen does not store or have access to your full payment card details.

6d. Failed Payments

If a recurring or one-time payment fails, Melogold Kitchen may attempt to reprocess the payment. Continued payment failure may result in paused or suspended service until payment is successfully completed. Failure to pay may result in suspension or termination of service.

8. Business Closures

Melogold Kitchen is closed during the final two weeks of December (Christmas and New Year’s). Exact dates will be communicated in the weeks prior. Members will not be billed during this period.


9. Modifications to Service

Melogold Kitchen reserves the right to update menus, pricing, policies, or this Agreement with reasonable advance notice. Continued use of services after notice constitutes acceptance.


10. Limitation of Liability

To the fullest extent permitted by California law, Melogold Kitchen’s liability for any claim arising from this Agreement shall be limited to the amount paid by Client for the affected week of service.

Melogold Kitchen is not responsible for service interruptions, delays, or errors caused by third-party platforms, including website hosting providers, payment processors, delivery routing software, or other technical systems outside of our direct control. 



11. Governing Law

This Agreement shall be governed by the laws of the State of California, without regard to conflict-of-law principles.
